A Study on Legal Problems and Proposal for an Enactment Regarding MERS in the Republic of Korea

Abstract
This study aims to make proposals for a more concrete basis in the interpretation and application of the Korean legal regime in global infectious disease emergency situations.
Countries with primary infections of MERS-CoV(Middle East respiratory syndrome coronavirus) are located in the Middle East, but sporadic cases have been exported to other countries. The Republic of Korea reported its first laboratory-confirmed case of MERS-CoV. on 20 May 2015. Since the first index case, Republic of Korea experienced hospital-associated outbreak of MER-CoV, resulting in 186 infected human cases and 38 deaths as of 25 November 2015. Such event highlighted the current isolation, quarantine and indemnity in outbreak response.
The key point of a respond system for infectious diseases is to offer an appropriate balance in case conflicts arise between having to effectively cut off the spread of an infectious disease, and safeguarding the human rights of patients and those who are suspected of carrying or being at risk for the disease. In such situations, it is often unavoidable to restrict the freedom and rights of citizens while imposing a legal onus.
The purpose of an enactment is to establish a specific national public health and security measurement system to prevent and control infectious diseases such as new and mutant infectious diseases that could flow in from overseas countries, which may threaten society and/or cause damage and loss to the nation.
